A contract is a legal transaction consisting of at least two parties’ declarations of intent to produce a legal result. Under the contract, the parties are defined as debtor and creditor. Agreements must have at least one debtor and one creditor. The number of creditors and debtors can be more than one. In the case of mutual consent, the contracts are valid. Contracts are also mentioned in our constitution. Article 48 of the Constitution mentions the “freedom of work and contract”. Every individual has the freedom to work and to make contracts.
The parties to the contract have the freedom to arrange the contract as they wish. However, no regulation can be made contrary to the mandatory provisions of the law. Freedom of contract also has limits. Contracts that contain issues that are contrary to personal rights, morality and legal rules are void. There is no special law called contract law in Turkish law. Although there is no such branch as contract law, contracts are mentioned in all branches of law. There are many provisions related to contract provisions, results and sanctions.
